1. Acceptance of Terms

By using Polymorf ("Service"), you agree to these Terms of Service ("Terms"). If you don't agree, please don't use the Service. These Terms form a binding agreement between you and Polymorf Labs, Inc. ("Polymorf," "we," "us," or "our").

We may update these Terms from time to time. If you keep using the Service after a change, that counts as acceptance. We recommend checking back here occasionally.

2. Description of Service

Polymorf is an AI-powered platform for building, deploying, and managing workflows and automation. The Service includes:

• AI-assisted content generation and transformation tools
• Workflow automation and orchestration
• API access for connecting with third-party services
• A dashboard and analytics for tracking usage and performance

We're always working on the product. Features may change, improve, or occasionally be removed as we evolve.

3. User Accounts

Most features require an account. When you create one, you agree to:

• Provide accurate and up-to-date information during registration
• Keep your account details current
• Keep your login credentials secure and confidential
• Take responsibility for everything that happens under your account
• Tell us right away if someone uses your account without permission

We can suspend or close accounts that violate these Terms or that have been inactive for a long time.

4. Acceptable Use

You agree not to use the Service to:

• Break any law, regulation, or violate anyone's rights
• Create, spread, or help produce harmful, misleading, or illegal content
• Reverse-engineer, decompile, or disassemble any part of the Service
• Interfere with or degrade the Service's performance
• Get around usage limits, rate limits, or access controls
• Scrape, crawl, or extract data from the Service using automated tools without our permission
• Pretend to be someone else or misrepresent who you are
• Build competing AI products or services using Polymorf without our written consent

5. Intellectual Property

The Service, its content, features, and functionality belong to Polymorf Labs, Inc. They are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

Your content stays yours. When you upload or submit content ("User Content"), you give us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display it, but only to run and deliver the Service to you.

6. AI-Generated Content

Content the Service produces using AI ("AI Output") is provided as-is. Here's what that means:

• AI Output may not always be accurate, complete, or right for your use case
• You're responsible for reviewing and verifying all AI Output before you use it
• We don't guarantee that AI Output is original or won't infringe on someone's rights
• You take full responsibility for how you use AI Output, including staying compliant with the law

As long as you follow these Terms, you keep the rights to AI Output generated through your use of the Service, to the extent the law allows.

7. Data Privacy

Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Service, you agree to those practices.

We don't sell your personal information to third parties. Period.

8. Payment Terms

Some features cost money. If you use paid features:

• You agree to pay the fees listed on our pricing page
• We bill in advance, monthly or annually, depending on your plan
• Fees are non-refundable unless these Terms say otherwise or the law requires it
• We'll give you at least 30 days' notice before changing prices
• If you don't pay, we may suspend or cut off access to paid features

You're responsible for any applicable taxes, except taxes on our income.

9. Limitation of Liability

TO THE FULLEST EXTENT THE LAW ALLOWS, POLYMORF LABS, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. THIS INCLUDES LOST PROFITS, LOST DATA, LOSS OF USE, OR LOSS OF GOODWILL ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU WILL NEVER EXCEED WHAT YOU PAID US IN THE 12 MONTHS BEFORE YOUR CLAIM, OR $100, WHICHEVER IS MORE.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Termination

We can suspend or terminate your access at any time, without notice, if you breach these Terms. When that happens:

• Your right to use the Service ends immediately
• We may delete your account and data after a reasonable retention period
• Sections that should survive termination will survive, including ownership, warranty disclaimers, and liability limits

You can delete your account anytime by reaching out to us or using the account deletion feature in the Service.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law rules. Any legal action related to these Terms must be filed in state or federal courts in Delaware, and you agree to the jurisdiction of those courts.

12. Changes to Terms

We can update these Terms at any time. For material changes, we'll give you at least 30 days' notice before the new terms take effect. What counts as "material" is up to us.

If you continue using the Service after updated Terms take effect, you're agreeing to them.
